NOTICE OF VIOLATION

In accordance with the requirements of Rule 62-625.500 (2)(b)8, Florida Administrative Code, notice is hereby given that Mastercut Tool Corp. at 965 Harbor Lake Drive, Safety Harbor, FL 34695 was in Significant Non-Compliance (SNC) with the City of Safety Harbor, Industrial Pretreatment of Wastewater Ordinance, Article VIII. Division 9. Sec. 24.181(b). TECHNICAL REVIEW CRITERIA (TRC): Silver concentrations exceeded 1.2 times the daily limit (1.2 X .43mg/L= .516mg/L) in 3 out of 8 samples, or 37.5% of the measurements taken and silver concentrations exceeded 1.2 times the monthly average limit (1.2 X .24 mg/L = .288 mg/L) in 2 out of 3 samples, or 66.6% of the measurements taken between 10/01/2019 and 03/31/2020.
Zinc concentrations exceeded 1.2 times the monthly average limit (1.2 X 1.48 mg/L = 1.776 mg/L) was exceeded in 2 of the 4 Zinc monthly averages or 50% of the measurements taken between 10/01/2019-03/31/2020. CHRONIC SIGNIFICANT NON-COMPLIANCE: Silver concentrations exceeded the monthly average limit of 0.24 mg/L 66% of the time between 10/01/2019-03/31/2020 and zinc concentrations exceeded the monthly average limit of 1.48 mg/L 75% of the time between 10/01/2019-03/31/2020.

The Federal Emergency Management Agency and Florida Division of Emergency Management have received the following application for Federal grant funding.  Final notice is hereby given of the Federal Emergency Management Agency’s (FEMA) consideration to provide funding in the form of Hazard Mitigation Grant Program. Funds will be provided in accordance with Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, Public Law 93-288, as amended.

Under the National Environmental Policy Act (NEPA), federal actions must be reviewed and evaluated for feasible alternatives and for social, economic, historic, environmental, legal, and safety considerations. Under Executive Order (EO) 11988 and EO 11990 FEMA is required to consider alternatives to and to provide public notice of any proposed actions in or affecting floodplains or wetlands. EO 12898 also requires FEMA to provide the opportunity for public participation in the planning process and to consider potential impacts to minority or low-income populations.

Funding for the proposed project will be conditional upon compliance with all applicable federal, tribal, state and local laws, regulations, floodplain standards, permit requirements and conditions.

Proposed Work and Purpose:

The City of Clearwater will elevate the telemetry, control panels, and power connections of the 8 Clearwater Beach lift stations to at least two (2) feet above the base flood elevation. Elevating the electrical components of the lift stations will reduce the risk of storm damage, thereby protecting the efficacy of the lift stations and reducing the risk of sanitary sewer overflows due to loss of functions.

Project Alternatives:

The alternatives to the project that have been and will be considered are 1) the no action alternative and 2) submersible panel retrofits. These alternatives to the proposed project are not viable because under Alternative 1) the City will continue to experience sanitary sewer overflows due to extreme flooding and surge which can cause water quality issues, create public health and safety hazards, and potentially impact coast zones, wetlands, fisheries, and historic resources; and Alternative 2) increased construction labor and ongoing maintenance cost and lack of accessibility, perhaps even during a flood event which could still result in a failure and sanitary sewer overflow.

Comment Period:

Comments are solicited from the public; local, state or federal agencies; and other interested parties in order to consider and evaluate the impacts of the proposed project.  The comments should be made in writing and addressed to the Florida Division of Emergency Management, Bureau of Recovery and Mitigation, 2555 Shumard Oak Blvd., Tallahassee, FL 32399-2100.  These are due within 15 days of this notice.  The State will forward comments to applicable regulatory agencies as needed.  Interested persons may submit comments, obtain more detailed information about the proposed action, or request a copy of the findings by contacting:

The City of Clearwater proposes to adopt the following ordinance:

ORDINANCE NO. 9387-20

AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA MAKING AMENDMENTS TO THE COMMUNITY DEVELOPMENT CODE BY AMENDING Section 3-1202.G to allow the comprehensive landscaping program to be utilized in the US 19 District; amending section 3-1401.C to require City Engineer approval for methdology of parking demand study; Amending Section 3-2103 to permit certain temporary uses within the US 19 District where previously none were permitted, AND to allow all detached dwellings and duplexes to have garage, yard or estate sales; Amending Appendix B, Section B-103 to provide additional descriptions OF DEVELOPMENT STANDARDS WITHIN THE APPENDIX; Renaming and amending APPENDIX B, Section B-104 to clarify exemptions for improvement, remodel or reconstruction projects and internal building and additions within the US 19 District and to incorporate additional descriptions section references; Amending aPPENDIX B, Figure 1. FINAL PUBLIC NOTICE

The Federal Emergency Management Agency (FEMA) has received the subgrant application for the City of Clearwater’s Downtown Marina dock repairs due to Hurricane Irma (DR-4337-FL PW 06540). Pursuant to Executive Order 11988 and 44 CFR Part 9.12, final notice is hereby given of FEMA’s intent to provide funding for this project under the Public Assistance (PA) Program.

An initial disaster-wide Public Notice was published October 6, 2017 for Hurricane Irma. Comments and other information received were fully evaluated by FEMA along with evaluation of social, economic, environmental, and safety considerations. This notice serves as a project-specific final notice for FEMA’s funding action located within the floodplain.

Funding for the proposed project will be conditional upon compliance with all applicable federal, tribal, state, and local laws, regulations, floodplain standards, permit requirements and conditions.

Floodplain 

The project is located in a VE Zone per Pinellas County FIRM Panel # 12103C0108 H, dated 05/17/2005.

Proposed Work and Purpose
The downtown Clearwater fishing dock and loading dock were damaged as a result of Hurricane Irma. The applicant replaced the wave attenuator, mooring piles, cast aluminum cleats, HDPE pad, lighting, markers, gang way, railing, plumbing and hose bibs at the fishing dock. Mitigation measures were incorporated for the fishing dock by using improved materials and design. The applicant removed, furnished, and installed 48 feet of the loading dock. This repair and replacement project restored the facility to predisaster function.

 

Project Alternatives
The no-action alternative was considered. With the no action alternative, continued negative impacts on residents and the community may be experienced as the facility provides a recreational space facilitating open-space use of the floodplain. The fishing dock also serves as a wave attenuator, minimizing the impact of waves on the marina. Alternate locations were not considered as the marina docks are functionally- dependent on their location within the floodplain.

This will serve as the final public notice regarding the above-described action funded by the FEMA PA program. CITY OF CLEARWATER, FLORIDA

FY 2020-2021 - CONSOLIDATED ANNUAL ACTION PLAN

COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM

AND

HOME INVESTMENT PARTNERSHIP PROGRAM

The City of Clearwater is estimated to receive $­837,360 in grant allocation funds under the Community Development Block Grant (CDBG) Program and $431,436­ in grant allocation funds under the HOME Investment Partnerships (HOME) Program for the FY 2020-2021 Program Year beginning October 1, 2020. Funds can only be used in the incorporated limits of the City of Clearwater. However, an agency that is located outside the City may receive funding if they provide documented services for city residents.

Federal funding authorization for the CDBG Program and the HOME Program is through the U. S. Department of Housing and Urban Development. In addition to the grant allocations, the City anticipates that it will receive program income from the federal CDBG and HOME Programs. Other program funds may be available through the Pinellas County Housing Trust Fund (PCHTF) Program in the amount of $250,000.

These funds will primarily be used for housing, community and economic development activities.  A portion of the funds listed above may be used for City conducted and/or sponsored projects and may not be available for allocation to applicants.  Federal regulations applicable to these programs dictate funding availability for certain projects.  Proposals for new projects are being accepted beginning on­­­­­­­­­ February 28, 2020.  Suggestions for new projects/activities for FY 2020-2021 may be presented and should address one or more of the following strategies:

  • Promote better livable opportunities in the Neighborhood Revitalization Strategy Areas (NRSA); NRSA maps can be located at www.myclearwater.com/affordablehousing
  • Promote affordable housing for renters and/or homebuyers
  • Promote efforts/activities to end chronic homelessness
  • Provide outreach and housing opportunities for homeless individuals and families
  • Provide assistance to victims of domestic violence
  • Promote economic opportunities for very low- to moderate- income individuals
  • Provide assistance to the elderly, persons with disabilities and persons with HIV/AIDS
  • Develop public facility projects in the NRSAs
  • Promote efforts to reduce lead poisoning in children
  • Promote opportunities to end poverty (job training, employability skills, educational attainment and other related activities)
  • Promote opportunities to assist public housing residents to become self-sufficient
  • Promote opportunities for individuals to reduce their dependency on alcohol and drugs
  • Promote fair housing opportunities

Eligible activities may include, but are not limited to, rehabilitation and preservation of buildings and improvements, acquisition and disposition of real property, acquisition, construction, reconstruction, rehabilitation or installation of public facilities and improvements, economic activities and activities by subrecipients to carry out neighborhood revitalization, energy conservation projects and related projects.

Applications for organizations desiring to participate in the City of Clearwater Housing Pool for activities involving down payment assistance/gap financing, new construction and rehabilitation of single and multi-family housing will be accepted from eligible participants on a year-round basis while funds remain available.

FY 2020-2021 - CONSOLIDATED ANNUAL ACTION PLAN

COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM
AND
HOME INVESTMENT PARTNERSHIP PROGRAM

The City of Clearwater is estimated to receive $¬837,360 in grant allocation funds under the Community Development Block Grant (CDBG) Program and $431,436¬ in grant allocation funds under the HOME Investment Partnerships (HOME) Program for the FY 2020-2021 Program Year beginning October 1, 2020. Funds can only be used in the incorporated limits of the City of Clearwater. However, an agency that is located outside the City may receive funding if they provide documented services for city residents.

Federal funding authorization for the CDBG Program and the HOME Program is through the U. S. Department of Housing and Urban Development. In addition to the grant allocations, the City anticipates that it will receive program income from the federal CDBG and HOME Programs. Other program funds may be available through the Pinellas County Housing Trust Fund (PCHTF) Program in the amount of $250,000.

These funds will primarily be used for housing, community and economic development activities.  A portion of the funds listed above may be used for City conducted and/or sponsored projects and may not be available for allocation to applicants.  Federal regulations applicable to these programs dictate funding availability for certain projects.  Proposals for new projects will be accepted beginning on February 28, 2020.  Suggestions for new projects/activities for FY 2020-2021 may be presented and should address one or more of the following strategies:

•    Promote better livable opportunities in the Neighborhood Revitalization Strategy Areas (NRSA); NRSA maps can be located at www.myclearwater.com/affordablehousing
•    Promote affordable housing for renters and/or homebuyers
•    Promote efforts/activities to end chronic homelessness
•    Provide outreach and housing opportunities for homeless individuals and families
•    Provide assistance to victims of domestic violence
•    Promote economic opportunities for very low- to moderate- income individuals
•    Provide assistance to the elderly, persons with disabilities and persons with HIV/AIDS
•    Develop public facility projects in the NRSAs
•    Promote efforts to reduce lead poisoning in children
•    Promote opportunities to end poverty (job training, employability skills, educational attainment and other related activities)
•    Promote opportunities to assist public housing residents to become self-sufficient
•    Promote opportunities for individuals to reduce their dependency on alcohol and drugs
•    Promote fair housing opportunities

Eligible activities may include, but are not limited to, rehabilitation and preservation of buildings and improvements, acquisition and disposition of real property, acquisition, construction, reconstruction, rehabilitation or installation of public facilities and improvements, economic activities and activities by subrecipients to carry out neighborhood revitalization, energy conservation projects and related projects.

Applications for organizations desiring to participate in the City of Clearwater Housing Pool for activities involving down payment assistance/gap financing, new construction and rehabilitation of single and multi-family housing will be accepted from eligible participants on a year-round basis while funds remain available.

A Neighborhood Revitalization Strategy is a group of comprehensive community revitalization strategies that seek to create partnerships among the local government, the private sector, community organizations and neighborhood residents. The goal is to stimulate the reinvestment of human and economic capital by economically empowering low- to moderate-income residents. This community forum will help to prioritize needs and identify strategies that may be eligible for federal funding through the Community Development Block Grant (CDBG) and HOME Investment Partnerships Program under the U.S. Department of Housing and Urban Development (HUD).  Wade Trim Consultants will lead a discussion at two separate community meetings to obtain your comments.
