CITY OF CLEARWATER, FLORIDA

The City Council of the City of Clearwater, Florida, will hold public hearings on the following proposed ordinances on November 3, 2022, beginning at 6:00 P.M., or as soon thereafter as an ordinance may be heard, in the Clearwater Main Library, City Council Chambers, 100 N. Osceola Avenue, Clearwater, Florida. The proposed ordinances may be inspected in the office of the City Clerk, located at City Hall.  At the public hearing, interested parties may appear and be heard with respect to the ordinances. LOCAL HOUSING INCENTIVE STRATEGIES

The City of Clearwater is hereby inviting citizens, representatives of public and private agencies and organizations, and other interested parties to public hearings convened by the Affordable Housing Advisory Committee (AHAC) and City Council. The public hearing by the AHAC will be conducted on Monday, November 7, 2022, beginning at 9:00am. The public hearing by the City Council will be conducted on Thursday, December 1, 2022, beginning at 6:00pm. Both public hearings will be held in the City Council Chambers, Clearwater Main Library, 100 N. Osceola Avenue, Clearwater, Florida 33755. Public participation is invited and encouraged.

The City receives State Housing Initiatives Partnership (SHIP) Program funding from the State of Florida for use in implementing partnership programs to produce and preserve affordable housing for very low to moderate-income families. Florida Statutes (F.S.) require counties and cities receiving SHIP funds to appoint an eleven member AHAC. The duties of the AHAC are to recommend specific actions or initiatives to encourage or facilitate the production and preservation of affordable housing and to present their recommendations to City Council.

The purpose of these public hearings is to receive comments from the public on the following incentive strategies to be evaluated and recommended by the AHAC.

(a) The processing of approvals of development orders or permits for affordable housing projects is expedited to a greater degree than other projects, as provided in s. 163.3177(6)(f)3, F.S.

(b) All allowable fee waivers provided for the development or construction of affordable housing.

(c) The allowance of flexibility in densities for affordable housing.

(d) The reservation of infrastructure capacity for housing for very-low-income persons, low-income persons, and moderate-income persons.

(e) Affordable accessory residential units.

(f) The reduction of parking and setback requirements for affordable housing.

(g) The allowances of flexible lot configurations, including zero-lot-line configurations for affordable housing.

(h) The modification of street requirements for affordable housing.

(i) The establishment of a process by which a local government considers, before adoption, policies, procedures, ordinances, regulations, or plan provisions that increase the cost of housing.

(j) The preparation of a printed inventory of locally owned public lands suitable for affordable housing.

(k) The support of development near transportation hubs and major employment centers and mixed-use developments.

The AHAC recommendations may also include other affordable housing incentives as evaluated and recommended by the AHAC during their public hearing.

At the City Council public hearing, the City Council will consider the recommendations of the AHAC. The City Council may approve, revise, or reject the AHAC recommendations.

A draft Local Housing Incentive Strategies (LHIS) report, including the incentives evaluation and tentative recommendations of the AHAC, will be available by November 2, 2022 for public viewing at www.myclearwater.com/housing. Due to the COVID-19 pandemic, hard copies will be made available only upon request. Public comments are welcomed. The City of Clearwater is hereby publishing the proposed Annual Action Plan (AAP) for Program Year (PY) 2022 to allocate federal funding from the Community Development Block Grant (CDBG) and HOME Investment Partnerships Program (HOME) under the U.S. Department of Housing and Urban Development (HUD). The AAP identifies projects and activities to be implemented by the City during PY 2022, which begins on October 1, 2022, and ends on September 30, 2023. In addition to the entitlement grant, funding allocations also include anticipated program income generated by the City’s Revolving Loan Fund as well as prior-year (i.e., carryover) resources from projects that were either cancelled or completed under budget to be applied toward new projects. CDBG funds are used to provide decent housing, suitable living environments, and economic opportunities to principally benefit low- and moderate-income persons. HOME funds are used to foster private sector partnerships with for-profit and non-profit organizations to develop affordable housing.

The City of Clearwater anticipates an estimated $897,475 in new CDBG funds, $1,231,980 in CDBG program income, and $767,422 in prior-year CDBG resources. The City also anticipates an estimated $509,528 in new HOME funds, $1,967,722 in HOME program income, and $2,003,239 in prior-year HOME resources.  These funds will be programmed to eligible activities under these grant programs.

The list below captures all proposed projects to be funded with CDBG and HOME resources in PY 2022. Funding for these and other projects are estimated resources only and funding amounts may increase or decrease based upon actual program income, prior-year adjustments, and/or final federal funding allocations. Due to these and other factors, the City of Clearwater reserves the right to add or delete projects and/or adjust funding allocations proportionally.

FY 2022-2023 ANNUAL ACTION PLAN

 

COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AND HOME INVESTMENT PARTNERSHIPS PROGRAM

The City of Clearwater is estimated to receive $922,626 in grant allocation funds under the Community Development Block Grant (CDBG) Program and $452,259 in grant allocation funds under the HOME Investment Partnerships (HOME) Program for Federal Fiscal Year (FY) 2022-2023 beginning October 1, 2022. Funds can only be used in the incorporated limits of the City of Clearwater. However, an agency that is located outside the City may receive funding if they provide documented services for city residents.

Federal funding authorization for the CDBG Program and the HOME Program is through the U.S. Department of Housing and Urban Development. In addition to the grant allocations, the City anticipates that it will receive program income from the federal CDBG and HOME Programs.

These funds will primarily be used for housing, community, and economic development activities. A portion of the funds listed above may be used for City conducted and/or sponsored projects and may not be available for allocation to applicants. Federal regulations applicable to these programs dictate funding availability for certain projects. Proposals for new projects will be accepted beginning on February 16, 2022. Suggestions for new projects/activities for FY 2022-2023 may be presented and should address one or more of the following strategies:

  • Promote better livable opportunities in a designated Neighborhood Revitalization Strategy Area (NRSA); NRSA maps are located at www.myclearwater.com/affordablehousing
  • Promote affordable housing for renters and/or homebuyers
  • Promote efforts/activities to end chronic homelessness
  • Provide outreach and housing opportunities for homeless individuals and families
  • Provide assistance to victims of domestic violence
  • Promote economic opportunities for very low- to moderate- income individuals
  • Provide assistance to the elderly, persons with disabilities, and persons with HIV/AIDS
  • Develop public facility projects in the NRSAs
  • Promote efforts to reduce lead poisoning in children
  • Promote opportunities to end poverty (job training, employability skills, educational attainment, and other related activities)
  • Promote opportunities to assist public housing residents to become self-sufficient
  • Promote opportunities for individuals to reduce their dependency on alcohol and drugs
  • Promote fair housing opportunities

Eligible activities may include, but are not limited to, rehabilitation and preservation of buildings and improvements; acquisition and disposition of real property; acquisition, construction, reconstruction, rehabilitation or installation of public facilities and improvements; economic activities; and activities by subrecipients to carry out neighborhood revitalization, energy conservation projects, and related projects.

Applications for organizations desiring to participate in the City of Clearwater Housing Pool for activities involving down payment assistance/gap financing, land acquisition, new construction, and rehabilitation of single- and multi-family housing will be accepted from eligible participants on a year-round basis while funds remain available.

The City will be utilizing an online application that can be found by clicking the Apply Here Using Neighborly Software button located at www.myclearwater.com/affordablehousing beginning February 16, 2022. Additional information on utilizing Neighborly Software can be found under the Neighborly Software tab found on the website.

The City of Clearwater, Florida, is requesting applications from developers interested in applying for funding through the FY 2022-2023 State of Florida Low Income Housing Tax Credit (LIHTC) Program.  The applications are necessary for the consideration of providing City support for qualified multi-family housing development which meet the goals of the City and comply with applicable federal and state law. 

All applications submitted will be reviewed by the Economic Development and Housing Department who will make recommendations to the City Council.  The City Council has the authority to approve commitment letters and loans providing Local Government Contributions for developments seeking Florida Housing Finance Corporation (FHFC) Tax Credits and SAIL funding in conjunction with FHFC RFA 2022-205 and/or loans providing Local Government Area of Opportunity Funding in conjunction with FHFC RFA 2022-202. Submission of an application does not entitle the applicant to financing, even if sufficient funds exist.

NOTICE OF DRAFT PERMIT

The Department of Environmental Protection gives notice of its preparation of a draft permit to City of Clearwater Public Utilities Department, Richard Gardner, 1650 N. Arcturas Ave, Clearwater, Florida 33765 for the City of Clearwater Marshall Street WRF. This permit authorizes the permittee to operate a 10.0 mgd domestic wastewater treatment facility which would discharge 10.0 mgd of effluent to Stevenson Creek or land apply up to 10.0 mgd of reclaimed water to a slow-rate public access system. The facility is located at latitude 27o 58' 52.8323" N, longitude 82o 47' 14.3334" W on 1605 Harbor Dr, Clearwater, Florida 33755 in Pinellas County. The Department has assigned permit file number FL0021857-021-DW1P/NR to the proposed project.

Written Comments or Request for Public Meeting

Any interested person may submit written comments on the Department's proposed permitting decision or may submit a written request for a public meeting to Astrid Flores Thiebaud, 13051 N. The comments or request for a public meeting must contain the following information:

(a) The commenter's name, address, and telephone number; the applicant's name and address; the Department permit file number; and the county in which the project is proposed;

(b) A statement of how and when notice of the Department's action or proposed action was received;

(c) A statement of the facts the Department should consider in making the final decision;

(d) A statement of which rules or statutes require reversal or modification of the Department's action or proposed action; and

(e) If desired, a request that a public meeting be scheduled, including a statement of the nature of the issues proposed to be raised at the meeting.

If a public meeting is held, any person may submit oral or written statements and data at the public meeting on the Department's proposed action. As a result of significant public comment, the Department's final action may be different from the position taken by it in this draft permit.

Time Period for Submitting Written Comments or Requesting a Public Meeting

Comments submitted by any persons other than the applicant, and other than those entitled to notice under Rule 62-620.550, F.A.C., must be received within 30 days of publication of the public notice. Failure to submit comments or request a public meeting within this time period shall constitute a waiver of any right such person may have to submit comments or request a public meeting under Rule 62-620.555, F.A.C.

If a public meeting is scheduled, the public comment period is extended until the close of the public meeting. However, the Department may not always grant a request for a public meeting. Therefore, written comments should be submitted within 30 days of publication of this notice, even if a public meeting is requested.

NOTICE OF CONSENT ORDER

The Department of Environmental Protection ("Department") gives notice of agency action of entering into a Consent Order with City of Clearwater pursuant to section 120.57(4), Florida Statutes. The Consent Order addresses the effluent quality exceedances, unauthorized discharges, and overflows at the facilities and its collection system. The Consent Order is available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at the Department of Environmental Protection, Southwest District, 13051 N. Telecom Parkway, Suite 101, Temple Terrace, Florida 33637.

Persons who are not parties to this Consent Order, but whose substantial interests are affected by it, have a right to petition for an administrative hearing under sections 120.569 and 120.57, Florida Statutes. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition concerning this Consent Order means that the Department's final action may be different from the position it has taken in the Consent Order.

The petition for administrative hearing must contain all of the following information:

a) The OGC Number assigned to this Consent Order;

b) The name, address, and telephone number of each petitioner; the name, address, and telephone number of the petitioner's representative, if any, which shall be the address for service purposes during the course of the proceeding;

c) An explanation of how the petitioner's substantial interests will be affected by the Consent Order;

d) A statement of when and how the petitioner received notice of the Consent Order;

e) Either a statement of all material facts disputed by the petitioner or a statement that the petitioner does not dispute any material facts;

f) A statement of the specific facts the petitioner contends warrant reversal or modification of the Consent Order;

g) A statement of the rules or statutes the petitioner contends require reversal or modification of the Consent Order; and

h) A statement of the relief sought by the petitioner, stating precisely the action petitioner wishes the Department to take with respect to the Consent Order.

The petition must be filed (received) at the Department's Office of General Counsel, 3900 Commonwealth Boulevard, MS# 35, Tallahassee, Florida 32399-3000 or received via electronic correspondence at Agency Clerk@floridadep.gov, within 21 days of receipt of this notice. A copy of the petition must also be mailed at the time of filing to the District Office at Southwest District, 13051 N. Telecom Parkway Suite 101, Temple Terrace, Florida. Failure to file a petition within the 21-day period constitutes a person's waiver of the right to request an administrative hearing and to participate as a party to this proceeding under sections 120.569 and 120.57, Florida Statutes. These funds will primarily be used to assist eligible homebuyers in the purchase of homes within the city limits of Clearwater. For current homeowners, rehabilitation assistance may be provided to assist with code deficiencies within their dwellings.

Applications for funded strategies will be made available between October 1, 2021 and June 30th, 2022. Preference will be given to persons with special needs as defined in section 393.063, Florida Statutes.

Assistance is available to households whose maximum income is at or below 120% of Area Median Income (AMI). Priority will be given to households at 80% or below Area Median Income (AMI).

The Department of Environmental Protection gives notice of its preparation of a draft permit to the City of Clearwater Public Utilities Department, Mr. Richard Gardner, 1650 North Arcturas Avenue, Building C, Clearwater, Florida 33765 for the City of Clearwater Northeast WRF. This permit authorizes the permittee to operate an existing 13.5 mgd domestic wastewater treatment facility which discharges up to 13.5 mgd of effluent to Old Tampa Bay. This permit also authorizes land application of 12.0 mgd of reclaimed water to a Part III slow-rate public access system serving as a source plant for reclaimed water to the City of Clearwater Master Reuse System (FL0186261) and transfer of up to 4.0 mgd of reclaimed water to the City of Clearwater Groundwater Replenishment Advanced Water Purification Plant (FLA009486). The facility is located at latitude 28 o 1' 41.09" N, longitude 82 o 42' 17.72" W. on 3290 S.R. 580, Clearwater, Florida 34695 in Pinellas County. The Department has assigned permit file number FL0128937- 017-DW1P/NR to the proposed project.

The Department intends to issue the permit unless as a result of public comment appropriate changes are made.

Written Comments or Request for Public Meeting

Any interested person may submit written comments on the Department's proposed permitting decision or may submit a written request for a public meeting to Belinda Oliver, (Belinda.Oliver@FloridaDEP.gov), 13051 N. Telecom Pkwy, Suite 101, Temple Terrace, Florida 33637-926, in accordance with Rule 62-620.555, F.A.C. The comments or request for a public meeting must contain the information set forth below and must be received in the Department's Southwest District Office.

The comments or request for a public meeting must contain the following information:

a. The commenter's name, address, and telephone number; the applicant's name and address; the Department permit file number; and the county in which the project is proposed;

b. A statement of how and when notice of the Department's action or proposed action was received;

c. A statement of the facts the Department should consider in making the final decision;

d. A statement of which rules or statutes require reversal or modification of the Department's action or proposed action; and

e. If desired, a request that a public meeting be scheduled, including a statement of the nature of the issues proposed to be raised at the meeting.

If a public meeting is held, any person may submit oral or written statements and data at the public meeting on the Department's proposed action. As a result of significant public comment, the Department's final action may be different from the position taken by it in this draft permit.

Time Period for Submitting Written Comments or Requesting a Public Meeting

Comments submitted by any persons other than the applicant, and other than those entitled to notice under Rule 62-620.550, F.A.C., must be received within 30 days of publication of the public notice. Failure to submit comments or request a public meeting within this time period shall constitute a waiver of any right such person may have to submit comments or request a public meeting under Rule 62-620.555, F.A.C.

If a public meeting is scheduled, the public comment period is extended until the close of the public meeting. However, the Department may not always grant a request for a public meeting. Therefore, written comments should be submitted within 30 days of publication of this notice, even if a public meeting is requested.

Invitation to Bid - R’Club Child Care, Inc. - Sept. 15

INVITATION TO BID

R’Club Child Care, Inc. is soliciting sealed bids from licensed Contractors (General, Playground, and HVAC Contractors) for the following two projects at R’Club Early Learning Academy located at 1235 Holt Avenue, Clearwater, FL 33755. All materials furnished and all work performed shall be in accordance with the Specifications and other Contract Documents pertaining thereto, as prepared by R’Club Child Care, Inc.

  1. Renovation of two playground areas.  Removal of old playground equipment from two areas and installation of new age-appropriate equipment for the toddler and preschool playgrounds. All new playground equipment will meet national safety standards and will be installed in accordance with local regulations for childcare facilities.  The general scope of work includes obtaining a permit (if needed); coordinating site delivery; removal and disposal of older equipment in each area; each play area (approximately 22’ x 35’) will be cleared of debris, excavated, and crushed stone added and compacted to prepare for new equipment and rubber surfacing for safety; new age-appropriate equipment will be placed and installed over the prepared areas in each playground (toddler playground equipment is designed for children ages 6-23 months and includes five elevated components, and preschooler playground equipment is geared for children ages 2-5 years and combines elevated and ground structures); 2.5” thick Poured-in-Place rubber surfacing (total 990 square feet) will be installed on the playgrounds. 

     

  2. Removal and installation of new energy-efficient HVAC unit.  Removal and installation of new energy-efficient HVAC unit in the building’s south wing to replace an older unit. The new HVAC equipment to be installed includes a Trane 5-ton, 14 SEER heat pump with R-410 split system.  The specified equipment for the space is 4twr4060 condenser and Tem4ac60 air handler.  The general scope of work includes obtaining a permit; removal and disposal of old equipment; cap off old gas line and add safety float switch; Trane Condenser and Air Handler installation; upgrade electrical from 110 to 220 service; addition of new electrical disconnect box; duct modifications and fresh air duct extended; inclusion of digital thermostat and smoke detector.

A Pre-Bid Meeting will be held on September 15, 2022, at 10:00 AM at 1235 Holt Avenue, Clearwater, FL 33755 to review construction plans and specifications. Attendance at the Pre-Bid Meeting is strongly encouraged. An Invitation to Bid packet that contains the specifications and other contract documents will be available following the Pre-Bid Meeting. This project will be utilizing Community Development Block Grant (CDBG) funds provided through the United States Department of Housing and Urban Development (HUD).
